Dispute Resolution
Informal Negotiations
To expedite resolution and control costs of any dispute related to these Terms of Use (each a “Dispute”), the parties agree first to attempt to negotiate any Dispute informally for at least 30 days before initiating arbitration.
Binding Arbitration
If the parties are unable to resolve a Dispute through informal negotiations, the Dispute will be finally and exclusively resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”). Arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitration shall take place in Cook County, Illinois.
Except where otherwise required by applicable AAA rules or law, the arbitrator’s decision will be in writing, and any award may be entered in any court of competent jurisdiction.
Restrictions and Exceptions
The parties agree that any arbitration shall be limited to the Dispute between the parties individually, and no Dispute shall be joined with any other proceeding or on a class-action basis. Exceptions—any Disputes seeking to enforce intellectual property rights, or claims for injunctive relief—are not subject to arbitration and may be brought in court.
Corrections

Indemnification

User Data

Refunds
All subscription fees are non-refundable; except that you may cancel a renewed subscription in writing up to three (3) business days after the renewal date and receive a full refund of the new subscription fees. Contact support@blackspectacles.com for a refund. Discounts, rebates or other special offers are only valid while the subscription is active.
Registration
When registering an account, you agree to provide true, accurate, current and complete information. You are responsible for all activities under your account. You must monitor your account’s use by minors or unauthorized users and notify us promptly of any unauthorized use.
